As a US citizen is it my right to have an Administrative hearing to determine if my dogs are dangerous.

Or is it something that I am just entitled to and not guaranteed. Due to financial restraints I am unable to pay for a fee ($500) that my city says is required for me to be entitled to a hearing. I tried to ask for a fee waiver using Ca Gov Code 68630 but they said it was not applicable to the administrative process for this Anderson Municipal Code Action. If this hearing was held in Judicial court I would be able to. Shouldn't they have to also provide the same access to a waiver if they are choosing to hold an administrative hearing instead?

Can I demand a Judicial hearing instead? I feel my constitutional right to face my accuser and access to the justice system is being violated.

Your question is far too specific which means that any attorney responding to this question runs the risk of creating an attorney client relationship. It may be worth it to find an attorney to call and to pay for their time to get a proper consultation and even possible representation. Unfortunately, that may cost more than the fee itself.

What can my attorney bill twice for same work done again by a different attorney/paralegal?

I have an attorney who has delayed my case for over a year. It is a law firm and each time I call to ask on the status of my case they are not available and/or I find out that my paralergal has left and I have a new paralegal. I have gone through 3 paralegals now and 2 attorneys. However, they each have told me that they have to review my case and this include emails that I had sent the previous paralegal/lawyer. So each time a new paralegal reviews my paperwork i get billed for them doing so. How is it my fault that this law firm keeps getting new paralegals and lawyers and then I have to pay all over again for them to review my case. This case has been held back because of them and nothing to do with me delaying it. I have wanted this to move forward months ago but now i am told I have a brand new attorney and that he has to review my case. When the secretary had told me she had handed my case over to another attorney just a week ago and now i am told that i have a new attorney. I think they are extremely unprofessional and I have already dished out well over 5k for a custody mod. case and we have not even gone in to court! Are these charges legal? The charges are time spent to review my case and nothing else.

Attorneys may delay on a matter for many reasons, but this can sometimes constitute legal malpractice. It is in your best interest to retain counsel to communicate with this law office to straighten everything out, pronto. Otherwise, you may be being taken advantage of. Do you have a fee agreement?

If this is your likelihood, it may be worth it to retain an attorney to see if your license can be reinstated, even if it means taking money out for attorney fees.up to make sure if it is important to you that you receive your license back quickly, assuming there are no hitches at court.

How long to I have to wait for my lawyer to respond to me before it is considered a "non-responsive" action?

I asked to meet with my lawyer via email two weeks ago. I then sent a certified letter requesting a meeting since I receive no response. Another week has gone by and still no response.

I see this sort of behavior with malpracticing attorneys often when they have something to hide. Then again, there may be a very good reason why the attorney has not responded. It may behoove you to consult with counsel who you may want to intervene. In what type of matter is your lawyer representing you? Do you have a fee agreement?

How can I remove my attorney from court ?

Ask for a substitution of attorney, with the attorney of record substituting you back to yourself as your own lawyer. You can also find new counsel and have the new counsel substitute in as counsel of record.

Can I still get my license?

I got pulled over for driving without my headlights on. I only have a permit and was not driving with a licensed driver. The cop gave me a ticket for my headlights and told me the DMV would most likely not give me my license now, is this true?

It is very unlikely the DMV will never give you your license. But you will have to address your driving habits. Driving without headlights can cause deadly accidents.

LVN with pending DUI what do I tell The Nursing Board

I was charged with DUI in October 2014 and I haven't been convicted yet, I was not finger printed back in October but I was order to do a book and released in December, the book and release was reported to the California Boards of Vocational Nurses and they send me a letter requesting detailed information about the incident like I say I have not been convicted yet so half of the paper work they are asking for I don't have, and I can't really disclose much information about what happen since my case still pending what should I do? You will only have to report a conviction if you receive a conviction. However, if you receive less than a conviction, you'll have to report precisely what happened. Even if you only receive probation or even an outright dismissal of your criminal case, the Board will want to know all bout it. You'll need to supply the facts and documents regarding the circumstances along with a personal narrative that explains your mitigating factors if any. Counsel can usually help you draft a proper response that will reduce the chances your license will have an administrative accusation filed against it.

Can a non licensed business modify gun parts ?

I work for a company that cerakotes and hard anodize lowers and receivers. Is it against the law to provide these services on a cash basis without a permit or license ?

As long as the modifications don't make something legal, illegal, it is likely that the business can modify gun parts. However, should liability accrue, the fact the business is unlicensed can cause personal liability. This is an issue worth retaining counsel for to fully research on your behalf if you are concerned beyond legal conjecture.

Small claims limit is $10,000 in California, assuming a judge agrees to hear the case here. The practice of law seems like it would have happened in Arizona, so you may need to sue in Arizona. The retainer agreement you signed with the attorney will control in these instances. Please have counsel review your fee agreement.
